Terms of Use & Sale

These Terms of Use & Sale (“Terms”) govern access to and use of wildhorizonfineart.com (the “Site”) and direct purchases from Wild Horizon Fine Art LLC (“Wild Horizon Fine Art,” “we,” “us,” or “our”). By using the Site, you agree to these Terms to the extent permitted by applicable law. If you purchase through a gallery or another third party, that seller’s terms also apply to that transaction.
1. Site Purpose
The Site presents Camille Kouyoumdjian’s artwork, exhibitions, studio practice, journal or blog content, workshops, contact options, and opportunities to inquire about or purchase artwork and related products or services. Site content is provided for lawful personal, informational, and transactional use.
2. Eligibility and Accurate Information
You must have legal capacity to enter into a binding transaction to place an order. You agree to provide current, complete, and accurate information when submitting an inquiry, creating an account, or making a purchase. You may not impersonate another person or use payment, contact, or delivery information that you are not authorized to use.
3. Intellectual Property and Site License
All rights in original artwork and Site content are reserved as described in our Copyright & Content Use Policy. Subject to these Terms, you receive a limited, revocable, nonexclusive, nontransferable right to access and view the Site for lawful personal purposes. No ownership or intellectual-property rights are transferred by your use of the Site.
The Copyright & Content Use Policy is incorporated into these Terms by reference.
4. Prohibited Uses
You may not use the Site to:

Violate any law, regulation, third-party right, or these Terms.

Copy, reproduce, republish, distribute, sell, exploit, or create unauthorized derivative works from Site content.

Scrape, crawl, harvest, bulk-download, data-mine, or systematically extract Site content, images, pricing, contact information, or other data except as expressly authorized in writing.

Use Site content for artificial-intelligence or machine-learning training, fine-tuning, benchmarking, embeddings, datasets, model development, or automated content generation without prior written permission.

Mint, tokenize, list, trade, or use any Site artwork or image in connection with an NFT, blockchain token, digital collectible, or similar product without prior written permission.

Bypass access controls, interfere with Site security, introduce malicious code, overload the Site, probe vulnerabilities, or disrupt another user’s access.

Misrepresent affiliation with Wild Horizon Fine Art or the artist, or use the Site in a fraudulent, deceptive, defamatory, or abusive manner.
5. Artwork Descriptions and Images
We make reasonable efforts to describe artwork accurately. Original mixed-media artwork is handmade and may include texture, layered surfaces, collage, natural or found materials, visible brushwork, irregular edges, and other intentional variations. Screen calibration, lighting, photography, and device settings can cause color and scale to appear differently online. Dimensions and materials are stated as accurately as reasonably practical, but minor variations can occur.
Nothing in this section limits a buyer’s rights if an item is materially misdescribed, defective, or otherwise fails to conform to a non-waivable legal requirement.
6. Availability, Pricing, and Order Acceptance
Original artworks are unique and may be offered simultaneously through the studio, galleries, exhibitions, or the Site. An item shown as available can occasionally sell elsewhere before online inventory is updated. Placing an order does not guarantee acceptance until we confirm that the item is available and the transaction can be completed.
If an artwork has already sold, a material pricing or listing error occurred, or we cannot fulfill an order, we may cancel the affected order and promptly refund amounts paid as required by law. Prices, taxes, shipping charges, and any other required charges will be disclosed as required before purchase. We will not add a mandatory fee that applicable law requires to be included in the advertised price.
7. Payment
Payments may be processed through third-party payment services made available through the Site, invoices, or payment links. Your use of a payment service may be subject to that provider’s terms and privacy practices. You authorize the applicable payment amount when you submit a purchase and are responsible for ensuring that you are authorized to use the selected payment method.
8. Shipping, Returns, and Risk
Direct purchases are subject to our Shipping Policy and Return & Refund Policy, which are incorporated into these Terms. Those policies contain important deadlines, packing requirements, fees for voluntary returns, and procedures for transit damage. Mandatory consumer rights remain unaffected.
9. Copyright After a Physical Artwork Sale
Purchasing a physical artwork transfers ownership of the physical object, not copyright or reproduction rights. Unless a separate signed writing expressly provides otherwise, copyright and all reproduction, publication, licensing, merchandising, digital-use, and derivative-work rights remain with the artist and/or applicable rights holder.
10. Commissions and Custom Work
A commission or custom project may be governed by a separate proposal, invoice, or written commission agreement covering scope, size, price, deposit, revisions, approval, completion, delivery, cancellation, and copyright. If a separate written agreement conflicts with these Terms on a commission-specific issue, the commission agreement controls for that issue. Deposits and cancellation rights are governed by the disclosed commission terms and applicable law.
11. Gift Cards, Discounts, and Promotions
Gift cards, discount codes, newsletter offers, and promotions are subject to the terms disclosed with the offer or at purchase. Offers may have eligibility conditions, cannot be combined unless expressly stated, and have no cash value except where cash redemption or another treatment is required by law. We may correct or cancel a promotion that was published in error, subject to applicable law and any completed transaction rights.
12. Accounts, Reviews, and User-Submitted Content
If the Site allows you to create an account, submit a review, or provide other content for public display, you remain responsible for your content and must have the rights needed to submit it. You may not submit unlawful, infringing, misleading, defamatory, private, confidential, or malicious material.
To the extent you intentionally submit content for public display on the Site, you grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, format, and display that content as reasonably necessary to operate, promote, and archive the Site and our business. This license does not transfer ownership of your content. We may remove user content when reasonably necessary to enforce these Terms, protect rights, or comply with law.
13. Third-Party Websites and Services
The Site may contain links to galleries, social-media services, publications, payment services, embedded media, or other third-party websites. Third parties are not controlled by us, and their content, availability, terms, privacy practices, and services are their responsibility. A link does not by itself constitute endorsement or a guarantee.
14. Site Availability and Changes
We may change, suspend, or discontinue Site content or features from time to time. We do not promise uninterrupted or error-free access. We may update these Terms prospectively by posting a revised version and effective date. Changes do not retroactively remove rights that already vested under applicable law.
15. Disclaimers; Non-Waivable Rights
To the fullest extent permitted by law, the Site and general informational content are provided on an “as available” basis, and we do not guarantee that the Site will always be uninterrupted, error-free, or free of harmful code. However, nothing in these Terms excludes or modifies any warranty, remedy, consumer right, or liability that applicable law does not permit us to exclude or modify.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Wild Horizon Fine Art LLC and its owner, personnel, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the Site or from third-party content or services. This limitation does not apply to liability that cannot legally be limited, and it does not eliminate remedies for a direct purchase that applicable consumer law requires us to provide.
17. Indemnity for Unlawful Site Misuse
To the extent permitted by law, you agree to be responsible for losses, liabilities, and reasonable costs arising from your material violation of these Terms, your unlawful misuse of the Site, or your infringement of another person’s rights. This provision does not require a consumer to indemnify us for our own unlawful conduct or for liability that cannot legally be shifted.
18. Governing Principles; Mandatory Consumer Law
These Terms are interpreted under applicable United States federal law and applicable state law. If mandatory consumer-protection law in your place of residence applies to a transaction and cannot be waived by contract, those mandatory protections remain in effect. Nothing in these Terms is intended to deprive a consumer of rights that cannot lawfully be waived.
19. Severability; No Waiver; Entire Website Terms
If a provision of these Terms is found unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of future enforcement. These Terms, together with the policies expressly incorporated into them and any transaction-specific written terms, constitute the applicable agreement concerning use of the Site and direct purchases.
