Copyright & Content Use Policy

This Copyright & Content Use Policy applies to the website wildhorizonfineart.com and to original content displayed on it.

1. Copyright Ownership

Unless otherwise stated, copyright in the original artwork, photographs, images, graphics, written text, videos, and other original content displayed on this Site is owned by Camille Kouyoumdjian and/or Wild Horizon Fine Art LLC. Third-party names, trademarks, photographs, publications, embedded content, and other material remain the property of their respective owners.

Copyright protection arises under applicable law. Displaying a work on this Site does not place it in the public domain and does not grant a license except as expressly stated in this Policy or as otherwise provided by law.

2. Buying an Original Artwork Does Not Transfer Copyright

When you purchase a physical original artwork, you acquire ownership of that physical object only. Unless a separate written agreement signed by the copyright owner expressly states otherwise, the sale does not transfer copyright, reproduction rights, publication rights, merchandising rights, digital-use rights, or any other intellectual-property rights in the artwork. The artist retains the right to photograph, reproduce, publish, exhibit, license, and otherwise use images of the artwork, subject to applicable law and any separate written agreement.

3. Limited Permission to Access the Site

You may view Site content through an ordinary web browser for personal, lawful purposes. You may share a link to a public page on the Site. Any automatically generated link preview is governed by the platform that creates it. No other license is granted by implication, estoppel, or otherwise.

4. Uses Requiring Written Permission

Except to the extent a use is expressly permitted by law, you may not, without prior written permission from the copyright owner:

  • Download, copy, reproduce, scan, screenshot for republication, distribute, upload, repost, publish, publicly display, transmit, or create copies of Site images or text.

  • Use artwork or images in books, magazines, advertising, websites, social-media posts, presentations, films, merchandise, prints, products, promotional materials, or other publications.

  • Crop, recolor, edit, animate, alter, remove signatures or watermarks from, or create derivative works based on an artwork or image.

  • Sell, sublicense, mint, tokenize, list, trade, or otherwise use an artwork or image as or in connection with an NFT, blockchain token, cryptocurrency project, digital collectible, or similar product.

  • Use Site content to train, fine-tune, test, benchmark, evaluate, ground, embed, or populate any artificial-intelligence, machine-learning, computer-vision, generative model, dataset, model repository, or automated content-generation system.

  • Scrape, crawl, bulk-download, harvest, data-mine, archive, or systematically extract Site content for a database, dataset, image corpus, commercial research service, or other automated use.

  • Use any content in a way that falsely implies sponsorship, endorsement, affiliation, authorship, or permission.

5. Legal Exceptions Are Preserved

Nothing in this Policy is intended to prohibit a use that applicable law affirmatively permits without the copyright owner’s authorization, including a use that qualifies as fair use or another statutory exception. Whether a particular use is legally permitted depends on the facts and applicable law.

6. Copyright Management Information

Do not knowingly remove, conceal, falsify, or alter copyright notices, artist attribution, signatures, watermarks, metadata, or other copyright-management information associated with Site content or artwork except as permitted by law or authorized in writing.

7. Licensing and Permission Requests

For editorial, commercial, educational, publication, reproduction, or other licensing requests, contact camille@wildhorizonfineart.com before using the work. A license is effective only when its scope and terms have been agreed in writing by an authorized rights holder.

8. Reporting Infringement

If you believe content on the Site infringes rights you own, or if you want to report an unauthorized use of Wild Horizon Fine Art content elsewhere, please email us and include enough information to identify the work, the allegedly infringing material and its location, your contact information, and the basis for your claim. We may request additional information before acting.

9. Enforcement and Remedies

Wild Horizon Fine Art and the artist reserve all rights and remedies available under applicable law. Depending on the facts, available remedies for copyright infringement may include injunctive relief, actual damages and infringer profits, statutory damages when legally available, costs, attorneys’ fees when recoverable, and other relief ordered by a court or tribunal. No fixed damage amount or automatic multiplier is asserted by this Policy.

A decision not to enforce a right in one instance does not waive the right to enforce it later.
